Terms of Service

These terms govern your use of Bigger Than Pain. They explain what the platform is, what it isn't, and what we each agree to. Written to be understood, not to confuse.

1. Introduction and acceptance

These Terms of Service (“Terms”) govern your access to and use of the Bigger Than Pain platform (“BTP”, “the Platform”, “the Service”), including the website at biggerthanpain.com, the progressive web application, and all associated features, tools, content, and communications.

The Platform is operated by BiggerThanPain Limited, a company registered in Ireland (“we”, “us”, “our”).

By creating an account, completing onboarding, or using any part of the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Who we are

Bigger Than Pain is a digital wellness and self-management platform designed to support people living with persistent pain. It was developed by David Mc Gettigan, a Sports Rehabilitator and Pain and Movement Specialist with over 16 years of clinical experience.

The Platform is grounded in published evidence from pain science, rehabilitation, and behavioural health — and is designed to help users understand their pain, build confidence in movement, and develop sustainable self-management strategies.

We are not a medical practice, a clinical service, or a regulated healthcare provider.

3. What BTP is and is not

This section is important. Please read it.

3.1 What Bigger Than Pain is

Bigger Than Pain is a wellness, education, and self-management platform. It is designed to:

  • Help you understand the science of persistent pain in plain, accessible language
  • Support structured self-management through evidence-based tools, habit tracking, and guided exercises
  • Provide AI-assisted reflection and coaching to help you build awareness of your own patterns
  • Track your progress and surface insights from your own data
  • Deliver educational content grounded in published research

3.2 What Bigger Than Pain is not

Bigger Than Pain is not a medical service, a clinical service, or a substitute for professional healthcare. Specifically:

  • We do not diagnose conditions. Nothing on the Platform constitutes a diagnosis of any kind.
  • We do not prescribe treatment. Movement suggestions, tools, and content are for general self-management purposes and are not treatment recommendations tailored to a clinical assessment of your specific condition.
  • We are not a medical emergency service. If you are experiencing a medical emergency, stop using this app and call the emergency services immediately.
  • We do not replace your doctor, physiotherapist, consultant, or other healthcare provider.
  • Biggie, our AI guide, is not a clinician. See Section 10.

3.3 Adaptive personalisation

The Platform uses automated systems to adapt its guidance, content recommendations, and movement plans over time based on your tracked data and outcomes. This personalisation is designed to make the support more relevant to your patterns and needs. It does not constitute a clinical assessment or clinical decision, and all outputs remain subject to the non-medical limitations described in these Terms.

3.4 Belief and mindset content

Some content and AI-guided interactions on the Platform are designed to help you examine and, where helpful, reframe how you think about pain. This approach is grounded in published pain science and evidence-based psychological frameworks (including acceptance-based and cognitive approaches to pain management).

This content is educational and self-directed. It is not psychotherapy, counselling, or clinical psychology. If you are currently receiving psychological or psychiatric treatment, we recommend discussing your use of the Platform with your treating clinician before engaging with reflective or belief-reframing content.

4. Eligibility

To use Bigger Than Pain, you must:

  • Be at least 18 years of age
  • Be legally capable of entering into a binding contract
  • Not be located in a jurisdiction where use of the Platform is prohibited by law

The Platform is not designed for or directed at children under 18. If we become aware that a person under 18 has created an account, we will close that account and delete all associated data.

5. Your account

You must create an account to access the Platform. When registering, you agree to provide accurate, current, and complete information, and to keep that information updated.

You are responsible for maintaining the security of your account credentials. You must not share your login details with anyone else. If you become aware of any unauthorised access to your account, notify us immediately at support@biggerthanpain.com.

Each account is for the individual use of one person only. You may not create multiple accounts or share your account with others.

6. Founding member terms

This section applies to users who joined Bigger Than Pain as Founding Members prior to the general public launch of the Platform.

6.1 Lifetime access

Founding Members who were granted a Lifetime Membership receive ongoing access to the Platform for as long as the Platform is in operation, subject to compliance with these Terms. A Lifetime Membership means you will not be charged recurring subscription fees for access to the core Platform features available at the time of your membership.

6.2 What lifetime access includes

Your Lifetime Membership covers access to the core BTP platform, including all current modules and future updates to those modules. We may, at our discretion, introduce new premium features or add-on products in the future that are not included in Lifetime Membership. If we do, we will make this clear before charging for them.

6.3 Commitment to Founding Members

We will give Founding Members advance notice of any material changes to what their membership includes, and we will not retroactively reduce the core value of a Lifetime Membership without prior notification and reasonable remedy.

6.4 If the Platform closes

In the unlikely event that Bigger Than Pain ceases operation entirely, we will provide Founding Members with at least 90 days' notice where possible, and we will provide a full export of your personal data before closure.

7. Subscriptions, billing and payments

Where applicable, access to the Platform is provided on a subscription basis. Current pricing and plan details are published at biggerthanpain.com/pricing.

All payments are processed by Stripe. By providing payment details, you agree to Stripe's terms and privacy policy. We do not store your card details — we store only your Stripe customer ID and subscription status.

Subscriptions are billed in advance on a recurring basis and will automatically renew unless you cancel before the renewal date. We will give you at least 30 days' notice of any price increase.

8. Cancellation and refunds

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access until the end of the period for which you have paid.

We do not offer refunds for partial billing periods. Exception: If you are a consumer based in the EU or UK, you have a legal right to cancel within 14 days of purchase without giving a reason, provided you have not accessed and begun using the digital content.

Founding Member Lifetime Memberships are non-refundable after the 14-day cooling-off period.

9. Your health and your responsibility

Using the Platform does not transfer responsibility for your health to us. You remain solely responsible for:

  • Deciding whether the Platform is suitable for your individual circumstances
  • Consulting a qualified healthcare professional before making changes to your exercise, treatment, or medication
  • Monitoring your own response to any movement or self-management practice and stopping if it causes unexpected pain or distress

Stop and seek help immediately if you experience sudden severe pain, chest pain, shortness of breath, neurological symptoms (numbness, weakness, loss of bladder/bowel control), significant worsening of your condition, or thoughts of self-harm. Call the emergency services (999 in Ireland, 112 in the EU, 999 or 111 in the UK).

The Platform includes built-in guidance to prompt you to seek medical attention for certain symptoms (“red flags”). This is a general safety layer and does not constitute a clinical assessment.

10. AI-powered features — Biggie

Biggie is an AI-powered conversational guide within the Platform. Biggie is designed to help you reflect on your experience, understand pain science, navigate the Platform, and support your self-management.

Biggie is powered by Anthropic's Claude language model, operating under a system configuration developed by Bigger Than Pain to align with evidence-based pain care principles.

Biggie is not a clinician. Biggie cannot diagnose any condition, prescribe treatment, provide crisis support, or replace professional clinical judgment. AI language models can produce responses that are inaccurate, incomplete, or contextually inappropriate. If Biggie's guidance contradicts advice from your healthcare provider, follow your healthcare provider's advice.

When you use Biggie, your messages and relevant context are sent to Anthropic's API for processing. Anthropic does not use API inputs to train their models. See our Privacy Policy for full details.

11. Movement and exercise content

The movement and exercise content on the Platform is designed as general-purpose, evidence-informed self-management support. It is not a personalised exercise programme prescribed in response to a clinical assessment of your specific condition.

Physical exercise carries inherent risks. By engaging with the movement features, you acknowledge and accept this risk. You are responsible for listening to your body and modifying or stopping any exercise that causes unexpected pain or distress.

If you have any condition that may affect your ability to exercise safely, we strongly recommend obtaining medical clearance before using the movement features.

12. Data tracking and pattern insights

The Platform uses the data you log — including pain levels, mood, sleep, activity, and movement — to surface patterns and trends. These insights are generated algorithmically from your self-reported data and are observational and correlational — they do not constitute a clinical assessment.

12.1 Recovery direction scores

The Functional Recovery Engine computes weekly Recovery Direction Scores across multiple domains. These are intended as reflective tools to help you notice trends. They are not clinical outcome measures and should not be interpreted as medical assessments.

12.2 Phase and pattern inference

The Platform uses your onboarding data and ongoing tracking to assign you to an indicative recovery phase and to identify patterns in your pain experience (such as patterns associated with nervous system sensitisation, activity avoidance, or sleep disruption). These assignments are algorithmic heuristics designed to personalise your experience. They are not clinical diagnoses, are not verified by a clinician, and may not accurately reflect your individual clinical picture. Do not rely on them as a substitute for professional clinical assessment.

13. Wearable device integration

Connecting a wearable device to the Platform is entirely optional. You can revoke this connection at any time. Wearable data is provided for self-awareness purposes only and does not constitute clinical monitoring.

14. Educational content and the Vault

The Vault and other educational features contain summaries of published research and practical guidance. This content is for informational and educational purposes only and is not a substitute for professional advice tailored to your individual circumstances.

Educational content within the Vault uses semantic search powered by OpenAI's embedding model. Only course and educational content is processed — your personal data, chat messages, and health records are never sent to OpenAI.

14.1 Reflective and identity-based content

Some features of the Platform involve structured reflection on your personal experience of pain, your identity, and your relationship with your body. This content is designed to support recovery and is grounded in evidence-based approaches.

It is not psychotherapy. If you have a history of trauma, PTSD, or active mental health conditions, this type of reflective work may occasionally feel challenging. You are not obligated to engage with any content that does not feel right for you. If you find this content distressing, we encourage you to speak with a qualified mental health professional.

15. Community features

The Platform includes a community feature (“Gather”) where members can interact. When participating, you agree to treat other members with respect, not share or solicit personal medical information in a misleading way, and not post content that is abusive, discriminatory, or harassing.

Content posted by users reflects their views, not ours. We reserve the right to moderate or remove content at our discretion. Community spaces are not appropriate forums for seeking personalised medical advice.

16. Acceptable use

You agree not to use the Platform to:

  • Circumvent, disable, or interfere with security features
  • Access accounts or data belonging to other users
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Scrape, copy, or redistribute content without our written permission
  • Use automated tools to access the Platform
  • Upload viruses or malicious code
  • Attempt to extract or monetise the content, training methodology, or clinical framework of the Platform

17. Intellectual property

All content, design, software, clinical frameworks, AI configurations, and other materials on the Platform are owned by or licensed to us and are protected by Irish and international intellectual property law. This includes the Wayfinder Systems Model, Logic Shift Packets, the Functional Recovery Engine, and all written and video educational content.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your own personal, non-commercial self-management purposes.

18. User-generated content

Data you enter on the Platform — including tracking logs, journal entries, and chat messages — remains yours. We process it to deliver the service. Where you post content in community spaces, you grant us a non-exclusive, royalty-free licence to display that content within the Platform for as long as it remains posted.

19. Privacy and data protection

How we collect, use, store, and protect your personal data is set out in our Privacy Policy. The Privacy Policy forms part of these Terms.

For the purposes of GDPR, we are the data controller. By creating an account and completing onboarding, you provide explicit consent to the processing of your health-related data as described in the Privacy Policy.

If you have opted in to marketing communications, your email address is shared with Kit.com for the purpose of delivering those communications. You can unsubscribe at any time using the link in any email.

20. Third-party services

The Platform integrates with third-party services to operate (including Anthropic for AI, Stripe for payments, Resend for transactional email, Turso for database hosting, and Kit.com for marketing email). Use of these services is subject to their own terms and privacy policies.

We are not responsible for the availability, accuracy, or practices of third-party services.

21. Disclaimers

The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, we make no representations or warranties about the completeness, accuracy, or suitability of any content for any particular purpose, the uninterrupted operation of the Platform, or that use will result in any specific health outcome.

Use of the Platform does not guarantee any particular health outcome, recovery trajectory, or reduction in pain. Pain recovery is complex and non-linear.

AI-generated content may occasionally be inaccurate, incomplete, or inappropriate to your specific circumstances. We do not warrant the accuracy of AI-generated content.

22. Limitation of liability

To the maximum extent permitted by applicable law, our total aggregate liability to you shall not exceed the total amount paid by you to us in the 12 months preceding the event giving rise to the claim, or €100, whichever is greater.

We shall not be liable for any indirect, incidental, special, or consequential loss or damage, or any loss arising from your reliance on content on the Platform for clinical decision-making, your failure to seek professional medical advice, or third-party service failures.

Nothing in these Terms excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot lawfully be excluded under Irish law.

23. Indemnification

You agree to indemnify and hold harmless Bigger Than Pain, its founder, employees, contractors, and licensors from claims arising from your use of the Platform in breach of these Terms, content you post, violation of third-party rights, or your failure to seek or follow professional medical advice.

24. Suspension and termination

You may close your account at any time through your account settings. When closing your account, you have two options:

  • 90-day suspension — your account is suspended and your data is retained for 90 days. If you log back in within that period, your account is reactivated with all data intact. After 90 days, your data is permanently and irreversibly deleted.
  • Immediate permanent deletion — all your data is deleted immediately and cannot be recovered.

In both cases, any active subscription will be cancelled (at the end of your current billing period for suspension, or immediately for permanent deletion). We will send you a confirmation email with the date your data will be permanently deleted if you choose suspension.

We may suspend or terminate your access if you breach these Terms, your use poses a risk to other users, we are required to by law, or we discontinue the Platform (see Section 6.4 for Founding Members).

25. Governing law and jurisdiction

These Terms are governed by the laws of Ireland. You agree to submit to the exclusive jurisdiction of the courts of Ireland, without prejudice to your rights as a consumer under your country's law.

If you are a consumer in another EU member state, you retain the protections of your home country's mandatory consumer protection laws.

26. Dispute resolution

We would prefer to resolve any concern informally. Contact us at support@biggerthanpain.com and we will do our best to resolve it promptly.

EU consumers can also use the European Commission's Online Dispute Resolution platform.

27. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or in-app notification at least 14 days before the changes take effect. By continuing to use the Platform after changes take effect, you accept the updated Terms.
